Dolby Laboratories, Inc. and its affiliates ("Dolby") respect your concerns about privacy. This Privacy Notice, which applies to your use of any application or product offered by Dolby that you download from the Avid marketplace, including the Dolby Atmos Production Suite and Dolby Atmos Album Assembler (collectively, the "Dolby Professional Products"), describes the types of personal information Dolby obtains in connection with your use of the Dolby Professional Products, how we use the information, with whom we may share it, the rights you have with respect to your information, and the choices available to you regarding our use of the information. We also describe the measures we take to protect the security of the information and how you can contact us about our privacy practices. Your use of the Dolby Professional Products is voluntary. By downloading or using the Dolby Professional Products, or by voluntarily providing us with any personal information as described in the "Information We Obtain" section of this Privacy Notice, you accept and consent to the terms set forth in this Privacy Notice. If you do not agree to these terms, do not download or use the Dolby Professional Products.

 

Information we obtain

Dolby does not directly obtain any personal information in connection with your use of the Dolby Professional Products, but when you purchase the Dolby Professional Products we do obtain personal information from the Avid marketplace, subject to their privacy policy, including customer data such as your name, email address, account ID, product purchase information (e.g., name and quantity of product purchased), and country.

 

Information collected through third-party marketplaces, apps, tools, widgets and plug-ins is collected directly by the providers of these features. This information is subject to the privacy policies of the providers of the features. We encourage you to review the privacy policies and information provided by these third parties. We are not responsible for the privacy practices of these third parties.

The Dolby Professional Products is not designed to respond to "do not track" signals from U.S. devices.

 

How we use the information we obtain

We use the information described above to:

  • Provide products and services to you, such as alerting you to software updates of the Dolby Professional Products;
  • Facilitate and communicate with you about the feedback you provide regarding your use of the Dolby Professional Products;
  • Respond to your inquiries;
  • Operate, evaluate, and improve our business (including developing new products and services and enhancing, improving, and analyzing our products and services); and
  • Comply with and enforce applicable legal requirements, our End User License Agreement and our policies and procedures.

 

We may collect, process, and use your information as described in this Privacy Notice using manual or automated digital processing methods, which may include the use of database formats, cloud-based arrangements, and big data algorithms.

 

We also may use the information in other ways for which we provide specific notice at the time of collection.

 

Information we share

We do not disclose personal information we obtain about you in connection with the Dolby Professional Products, except as described in this Privacy Notice. We may share your personal information with our affiliates and subsidiaries to administer the Dolby Professional Products and for the purposes described in the "How We Use the Information We Obtain" section of this Privacy Notice. We also may share your information with our service providers located in the U.S. who perform services on our behalf based on our instructions and subject to appropriate contractual safeguards. We do not authorize these service providers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements.

 

We and our third-party service providers also may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government entities based on a lawful disclosure request or (iii) when we believe disclosure is necessary or appropriate to prevent harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. To the extent permitted by applicable law, we reserve the right to transfer personal information we have about you in the event of a proposed or completed sale or transfer of all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

The personal information we collect about you will be transferred to Dolby and its service providers in the U.S. U.S. laws may not provide the same level of data protection as the country in which you initially provided your personal information. When we transfer your information to other countries, we will protect that information as described in this Privacy Notice and in accordance with applicable law. If you are located in the European Economic Area ("EEA") or Switzerland, Dolby complies with applicable legal requirements providing for adequate protection for the transfer of personal information to countries outside of the EEA or Switzerland.

To the extent provided by the law of your jurisdiction, you may request access to the personal information we maintain about you or request that we correct, amend, delete or block the information by contacting us as indicated below. How we protect personal information 

We maintain administrative, technical and physical safeguards designed to protect personal information we obtain in connection with the Dolby Professional Products against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

 

Updates to our privacy notice

This Privacy Notice may be updated periodically and without prior notice to you to reflect changes in our personal information practices. We will post the updated version on https://www.dolby.com/us/en/about/privacy/avid.html and indicate at the top of the notice when it was most recently updated.
